Click on the pin, go to its options, and save the location as a new contact.

GEMA does not want to build cases against YouTube

The recycling law GEMA wants to the judgment of the Hamburg Regional Court in obtaining lawsuit against the video-sharing website YouTube is no blocking of other songs. That said Harald Heker, head of the organization, compared to the news magazine “Spiegel” (current edition).

“This process is very aware of a test case. The titles were selected randomly. Our hope is that YouTube is again seriously negotiating with us now,” said Heker. YouTube must either ensure the protection of copyright or a “clean contract” close.

The video platform in order to satisfy the judgment, install better filters. A second possibility would be the conclusion of a license agreement. However, both parties argue here for a long time about the level of compensation. The battle lines have hardened it.

“If YouTube can take these protective measures, that’s one possibility. If that’s not possible, would be an agreement with us as GEMA probably a necessary consequence,” explained Heker. It was prepared to negotiate. “We want to sue YouTube does not, we want a contract,” he said.

Contrary to the representation of YouTubes, the establishment of a filter system is technically not a sufficient extent possible, contrary to the IT lawyer and blogger Thomas Stadler. He holds the requirements of the judges’ very well to implement, “he told the news magazine ‘Focus’ (today’s edition).

To program an effective filtering software against illegal re-uploads, whether for the search engine giant Google owned company “certainly a little thing,” said Stadler. What YouTube is reasonable to legal action will, but only presumed on appeal or review authority clarified. In this specific case, it’s about these works. More may follow soon. Here is the last word “not spoken”.

WP7: ‘Apollo’ for any or no equipment?

For a lot of confusion, the statement has caused a Portuguese Microsoft evangelist, has meant that all Windows phones that are currently on the market, an update to Windows Mobile 8, also known under the code name Apollo get.

In a video interview with the Portuguese forum ‘Zwame’, whose translation is now of ‘ WMPoweruser has been published ‘, Microsoft evangelist Nuno Silva already said a while ago, that every Windows phone that is currently on the market, an update to “Apollo” get going.

Sun Silva said exactly that “will get all the latest equipment upgrade to the next major version of Windows Mobile, so Apollo.” Upon request, called the Microsoft evangelist, manufacturers and equipment (LG and Samsung, specifically remembered the name Omnia 7), and stressed that his statement applies to the first WP-generation. This would not only “current device” meant, but even older.

Microsoft would not comment further on the matter and told ‘ The Verge ‘, that is currently “not in terms of future publications” have decided to share. This in itself is not unusual, however, should current Windows Phone 7 owners make is still no great hopes.

After all is probably just the opposite: How ‘ The Verge ‘in a second story, citing a “close to Microsoft,” reports source that Silva’s statements are simply wrong. Rather, no current mango-unit (ieWindows Mobile 7.5) to get an Apollo experience. That might actually be the case, the normally well-informed Mary Jo Foley of ZDNet is using ‘Twitter’ announced that they have heard of her informants very similar information.

Should this information come true, then that would obviously not good news for current WP users. It suggests, however, many indications that the information is correct. In early March, Mary Jo Foley on ‘ ZDNet published ‘a story in which Terry Myerson, corporate vice president of Windows Phone, is quoted as saying that Microsoft is promising only that all of today’s WP7 apps will work on Apollo, but that at Microsoft also say “nothing to future versions” have.

The Hamburg Regional Court decided today that YouTube has removed the links to twelve of the GEMA disputed music videos. As the ‘ Frankfurter Allgemeine Zeitung ‘writes on its website, the court in seven cases, the PRO to be right, the applications for the remaining five videos were rejected for formal reasons, since the relevant time no other videos have been uploaded to YouTube.

According to the Hamburg court applies to YouTube, the so-called troublemakers-liability. What this means for the video portal that you mithaftet for possible violations of the user. Contravention YouTube now threatening a fine amounting to 250,000 euros, or a maximum six-month detention order.

The ‘ evening news ‘writes that YouTube now must install two filters to prevent the upload of multiple titles, to which GEMA has kept the rights. The portal is already used by the video filter system (“Content ID”) was not effective enough for GEMA (such as live recordings), the court followed the reasoning of the now “society for musical performing and mechanical reproduction rights.”

GEMA and YouTube, arguing for several years. By the end of March 2009 there was also a licensing agreement between the two parties, the subsequent negotiations for about a year unsuccessfully terminated , YouTube was not willing to pay the amount demanded by GEMA.

The currently available court judgment (first instance) is true only for the twelve pieces of music and does not go beyond. The ruling is seen as decisive for the copyright on the Internet, what consequences it will have but actually is, at present still not quite clear.

With this move, unusual among virtual operators, Movistar only offers coverage to its “subsidiary” Myspace, ONO, Digi and Ocean’s, while Vodafone is fattening its list of customers, which are Pepephone, Eroski Mobile or the mobile operators of regional cable companies.

What we know and probably never know are the terms by which operators pay MVNO with its own network by using this. The truth is that while using Vodafone coverage, especially Pepephone, focus their efforts on lowering the price of calls MVNOs Orange and Movistar coverage, including MÁSmovil or Myspace, they try to do every day cheaper bonds Internet.
